April 4, 2013: HUD Responds to Advocacy Regarding RAD; NHLP Urges Further Improvements

Earlier this year, NHLP urged HUD to improve tenants’ rights within the Rental Assistance Demonstration program (RAD). HUD has acknowledged the role of NHLP and the Resident Engagement Group in the development of the final rules regarding RAD. The RAD rules provide for tenant protections and long-term affordability; however, HUD must do more to ensure the necessary protections are embedded in amendments to the final RAD rules and documents.

The RAD program allows for the conversion of public housing to Project-based Section 8 or Project-based vouchers. HUD has taken steps to require tenant protections in the RAD conversions, and recently highlighted a housing authority’s use of Section 3 employment and economic opportunities to benefit public housing residents in several such conversions. As public housing is converted to Project-based Section 8 and Project-based vouchers, HUD must continue to ensure that tenant protections are included in the final documents. For example, failure to include relevant protections in tenant leases may lead to the loss of critical tenants’ rights. To learn how HUD can improve RAD rules, see NHLP’s comment letter.
