January 31, 2012: NHLP Joins Amicus Brief in Landmark Fair Housing Case

In 2011, the Supreme Court granted certiorari in Magner v. Gallagher, a case presenting the questions of whether disparate impact claims are cognizable under the Fair Housing Act and, if so, which test should be used in analyzing such claims. The outcome of Magner will affect several types of cases, including fair lending, zoning ordinances, siting of affordable housing, public housing agency preferences, and redevelopment of affordable housing. NHLP signed on to an amicus curiae brief explaining that the Fair Housing Act’s text and legislative history strongly support the conclusion that Congress intended the Act to cover disparate impact claims.
