Attention LALSHAC-ers, especially Massachusetts experts:

We, B.A.L.S. attorney Tom Difiore and I, need help about a "1-2-1" portability situation.

Our client had a voucher in the Cape Code area of Massachusetts from Housing Assistance Corporation in Hyannis, Mass. She has two children, one of whom is asthmatic, severely so according to her, with related psychological problems.

She transferred her voucher to the Housing Authority of the City of Tampa a little over three months ago, figuring that it would be better to be poor in Florida than poor in Massachusetts. However, she was not able to obtain work here; she has no family here; and she feels that the medical and psychological treatment for her asthmatic child is inadequate.

She now has come to believe that it was a big mistake to come to Florida. (cue: "There are places I remember...") Her landlord will give her a release; but the local PHA is using its no-move-within-first-year policy to deny her a transfer back to Mass.

Could she bypass our PHA and just re-apply to the Hous. Ass. Corp.? Is there an argument we can present to our PHA to "release" her to Mass.?

We'd like to be able to tell her something within the next 5-7 days.
