All letters to Residents with Potential Income Discrepancies and Notifications to Public Housing Agencies and Owners (POAs) have been mailed. Letters to project based Section 8 tenants and other residents receiving rental assistance under the Office of Housing Programs were mailed by August 18, 2000 and letters to Public Housing and tenant-based Section 8 participants were mailed by September 9, 2000. The notifications to owners were mailed by July 7, 2000 and to Public Housing Agencies by August 11, 2000.

The letters that tenants received requests that they contact the POA within 30 days. The Calendar Year 1998 Baseline Income Discrepancy Resolution Guide provides that if the tenant does not contact the POA, the POA should initiate contact with the tenant no earlier than 40 after notification to the POA. If POAs are following the HUD directive, this means that all POAs should have by now contacted tenants that have not already initiated the process themselves by contacting the POA.

The Guide provides for additional time lines in the event the tenant does not respond to the POA contact or has not received the HUD letter. In the event the letter is addressed to a resident other than the head of household, there are also time lines for when the POA must contact the head of household You can get that information from the Guide on HUD's website, Chapter 2, § 2.2.1.

NOTE: For public housing residents, HUD has now provided a link on the REAC income verification website to the pertinent HUD notices regarding the earned income disregard in effect for 1998. Unfortunately, neither the link or reference to the old earned income disregard is referenced in the body of the Guide, so some public housing authorities may miss the new posting.
