Our program (So. Ariz. Legal Aid) assists battered undocumented-alien spouses with VAWA immigration petitions (under the Kennedy Amendments to LSC). We have encountered problems with agencies considering these women ineligible for transitional housing programs when they reach their limit on emergency shelter stays. From what I can tell, these transitional housing programs are funded with a combination of McKinney Act, HOME, and CDBG funds. My reading of the HUD alien restrictions at 42 U.S.C. 1436a is that it does not apply to those funding sources even though they are administered by HUD. So these women should be eligible for these transitional housing programs. Does anyone out there have any further insight to this issue?
