National Housing Law Project
Section 8 Housing

Dear California Legal Services Provider and Low-income Housing Advocate:

NHLP is sending a letter to all California PHAs reminding them of the changes in the statue regarding  the 90 day notice for termination of Section 8 voucher tenants and application of California's "source of income" anti-discrimination statute.  Attachments to that letter include:

1. A memorandum regarding the 90 day notice and restriction on rent increases provided for in section 1954.535 of the California Code that applies to owners with federally assisted tenant-based contracts in jurisdictions with and without rent control.

2. A list of PHAs within California that are advising landlords to give 90 day notice of termination of tenancy.

3. An article regarding the application of California's "source of income" anti-discrimination statute to Section 8 tenants.
